Apple is facing a huge crisis for its Apple Watches. The US International Trade Commission has banned further sale of Apple Watches, pending litigation. The dispute originated over a patent dispute with device maker Masimo.

The company claims that Apple stole some of its medical technology, that it later incorporated into its watch. Masimo won the case, and the sale of the watch will be delayed pending an appeal. The Verge says:

It’s no longer possible to buy Apple’s latest flagship smartwatches, the Apple Watch Series 9 and Apple Watch Ultra 2, from the company’s online store. Apple has removed the devices from sale due to a forthcoming import ban imposed by the US International Trade Commission (ITC) that’s due to take full effect on December 26th. Both watches will disappear from Apple’s brick-and-mortar stores after December 24th.

The ban is the result of a patent dispute with medical device maker Masimo. The ITC has ruled that the SpO2 sensor in Apple’s smartwatches infringes upon Masimo’s patents. On Wednesday, the ITC denied Apple’s motion to stay the ban while awaiting an appeal.

Apple will no longer be able to sell new watches, though you might still be able to find older models through third parties. You won’t be able to exchange the watch, but will still be able to get a refund if within the allowed period. Android Authority reports:

Apple reportedly coached service representatives to tell affected customers they would be informed if and when Apple resumes replacements for older watch models.

Moreover, after the December 25 ban is instated, Apple will also stop exchanging watches purchased before the ban for a different color or size during the regular return period. Retail staff was reportedly informed that product exchanges won’t be allowed, but Apple will replace accessories like bands. Users will, however, be able to return the under-warranty watches for a refund.

While the Apple Watch is one of Apple’s product generating the least revenue, it is still a major issue for the company. Stock prices could take a fall, and consumers could start looking for alternatives. Apple will either settle the case, or develop its own alternative technology in case the appeal does not work.
